GemCities complies with the Digital Millennium Copyright Act (DMCA). This page explains how to submit a copyright takedown notice, how to file a counter-notice, and our policy on repeat infringers.

Submitting a Takedown Notice
If you believe content on a GemCities capsule infringes your copyright, send a written notice to the address above. To be valid under 17 U.S.C. § 512(c)(3), your notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notice, a representative list is acceptable.
- Identification of the material claimed to be infringing, with enough detail for us to locate it — specifically, the full Gemini URL (e.g.,
gemini://username.gemcities.com/filename.gmi). - Your contact information: name, address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Incomplete notices will not be acted upon. We will respond to valid notices within 48 hours by removing or disabling access to the identified content and notifying the account holder.
Warning: Submitting a false or bad-faith DMCA notice is a violation of 17 U.S.C. § 512(f) and may expose you to liability for damages, including attorney's fees.
Counter-Notice
If you believe your content was removed as a result of a mistake or misidentification, you may submit a counter-notice to dmca@gemcities.com. A valid counter-notice under 17 U.S.C. § 512(g)(3) must include:
- Your physical or electronic signature.
- Identification of the material that was removed and its location before removal (the Gemini URL).
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which GemCities may be found), and that you will accept service of process from the person who submitted the original takedown notice.
Upon receiving a valid counter-notice, we will forward it to the original complainant and restore the content within 10–14 business days unless the complainant notifies us that they have filed a court action seeking to restrain the activity.
Repeat Infringer Policy
GemCities will terminate the accounts of users who are found to be repeat infringers. An account is subject to termination upon receipt of two or more valid takedown notices against content posted by that account.
